Advice on Education Law for parents

At Huggins & Lewis Foskett we are able to advise parents with the appeals process if their child has not been admitted to a school of their choice. For both parents and their children this will be a very unsettling and anxious time. The uncertainty of where their children will be attending school may go on for several months. Admission authorities must issue guidance notes to help but for most parents dealing with the appeals process will be a new experience and one which they may not always be well prepared for.

We can also assist parents with an appeal on a decision to exclude their child from school or on the special educational needs appeals procedure. It may be appropriate to appeal a decision of an admissions authority or the exclusion of a child due to race or disability discrimination as all schools must comply with the Equality Act 2010.

We can guide parents through the process of their appeal to ensure that they submit a detailed case in advance. We can advise on how to question and challenge the admission authority’s position as a well prepared case could well make a difference to the outcome of an appeal.

As far as local authorities are concerned they are now obliged to comply with the fairly new School Admission Appeals Code that came into force on the 1st February 2012. The code applies to the admission authorities of maintained schools, governing bodies and local authorities (when not the admission authority) and admission appeal panels. We can advise admission authorities on any matters related to practice and procedure and compliance with the new code.
